EU finds cookies hard to swallow

Terry Street discusses a European Recommendation that aims to limit invisible processing on the Web.

The changing climate
In February this year, the working party on the protection of individuals with regard to the processing of personal data adopted a recommendation 1/99 about the Invisible and Automatic Processing of Personal Data on the Internet Performed by Software and Hardware.* There has been little publicity about this topic but the recommendation is aimed at the software and hardware industry and seeks to encourage them to comply with the European Data Protection rules. The working party reminds suppliers that for legitimate processing of personal data the data subject must be informed of the processing in question. The recommendation is concerned with all kinds of processing which are currently performed on the Internet without the knowledge of the person concerned and are hence "invisible" to the data subject.
